PLEASE NOTE: Until further notice Family Court of WA forms CANNOT be filed in the Federal Circuit Court of Australia 

A range of kits is available to assist you.  The kits provide information and some include the related form.  The kits are available in ".doc", ".rtf" and ".pdf" formats.

Family Dispute Resolution - Exemption Kit and Form

From 1 July 2008 parties who are considering applying to the court for parenting orders are required to have considered family dispute resolution (FDR) options.

The law has changed with effect from 1 July 2008.  A court will be unble to hear an application for parenting orders where it is not accompanied at the time of filing by either:

  • a certificate given to the applicant by a registered family dispute resolution provider; or
  • a duly sworn or affirmed Exemption Form (see downloads below).

Consent Orders Kit

Please provide the following documents at filing:

  • The original and 2 photocopies of the Application for Consent Orders (Form 11 with draft typed Consent Orders attached); and
  • Five (5) extra photocopies of the draft Consent Orders, certified by the applicant or lawyer as a true copy

[Note: You need to provide extra copies of the documents for any additional parties]

If the application is concerning children's issues:

  • De facto parties - a photocopy of the child/ren birth certificate/s
  • Married parties - a photocopy of the marriage certificate

If the application is concerning property/financial issues:

De facto parties-

  • The original and 2 photocopies of any affidavit being filed in support of the application
  • A photocopy of the Certificate/s of Title

Married parties-

  • A photocopy of the marriage certificate
  • A photocopy of the Certificate/s of Title
  • If requesting a splitting order for superannuation; a photocopy of the last 2 members statements for the superannuation fund being split and a letter from the company giving their approval for the fund to be split

Parenting Orders Kit

This kit is for persons thinking about asking the Family Court to make orders about their children.  A parenting order is one that deals with parental responsibility for a child including the person or persons a child is to live with, spend time with or communicate with.

This kit contains information about procedures and requirements and includes some sample parenting orders.
