Arbitration

Arbitration is an Alternative Dispute Resolution process.

Parties can attend arbitration as an alternative to commencing Family Court proceedings for a property settlement, or arbitration can be ordered by consent for matters in which there are current proceedings before the Court. For more information see the Family Court Brochure about Arbitration.

The Court has drafted standard arbitration orders to assist parties who seek consent orders referring their Family Court matter to arbitration.

The Court supports the use of arbitration in appropriate cases. Any relevant arbitration application filed in the court will be dealt with expeditiously by the designated arbitration judge.
