Minutes of Consent Orders

E-lodging Minutes of Consent Orders

At this time, Minutes of Consent Orders should not be eFiled via the CCP, even under the guise of correspondence by being attached to a letter.

If it is sought the Minutes be provided to the Court electronically, they should be sent via the Family Court email address (family.court@justice.wa.gov.au). They will then be printed and filed as per the normal procedure. A clean Word version should also be provided if the original Minute provided is a scanned PDF version.

If a signed Minute is provided electronically, the original need not be subsequently provided, but must be retained and available to produce to the Court upon request.

The Court will not provide service copies of Minutes of Consent Orders emailed to the Court. Compliance with Case Management Guideline 55.2 is always required.

When providing a clean typewritten and certified copy of a handwritten Minute previously handed up in Court, it should be a clean Word version that is emailed.

Minutes of Consent Orders lodged over the counter/by post

Unless filed electronically as per the above, notwithstanding any Rules or Case Management Guidelines to the contrary, when providing original Minutes of Consent Orders, parties are required to provide the original and any certified service copies they require, along with one additional certified copy for the Court to assist in the extraction of the orders.

Similarly, when providing a clean typewritten and certified copy of a handwritten Minute of Consent Orders previously handed up in Court, only one copy need be provided.

Form 11 Applications

When filing a Form 11 Application, the original Application with attached draft orders should be provided, together with certified service copies of the Application and attached draft orders, and one additional certified copy of the draft orders for the Court only, to assist in the extraction of the orders (unless eFiled – when no additional copies are required to be provided).

Minutes of Proposed Orders

All Minutes of Proposed Orders (in particular those requiring the provision of service copies) are to be filed over the counter, or by post. They should not be eFiled via the CCP, or lodged via the Family Court email address. They will not be accepted.

If the matter is urgent, leave must be sought in an attached letter indicating the urgency and why the Minute should be accepted for filing via email.

Other Documents

If a document is filed or provided electronically (via the CCP, by email or by fax), the original should not be subsequently provided to the Court, unless a specific direction is made to that effect by a Judicial Officer, but it must be retained and available to produce upon request. Multiple copies of documents will be returned to the party providing them.
