At this time in Western Australia, these changes only apply to property cases concerning parties who were, or are, married, and will apply to all new and existing matters from 10 June 2025, except where a final hearing/trial has already commenced.
The Act has been amended to include changes to the factors that the court needs to consider in making orders to ensure that property orders are just and equitable.
The amendments include the court having to consider the economic effect of any family violence, where relevant.
Other changes include parties being able to seek orders from the court about their companion animals (family pets).

It is expected that the state Family Court Act (which applies in property cases concerning parties who were in a de facto relationship) will also be amended to mirror the changes.
